Kim Zolciak Spotted for the First Time Since Temporary Loss of Primary Custody
Kim Zolciak resurfaced in head-to-toe black on an errand run — her first public outing since temporarily losing primary custody of the young children she shares with Kroy Biermann — in new photos captured by TMZ.
Kim Zolciak just popped back up in public after a rough week in court. TMZ posted photos from Sunday, May 10 that show the former Real Housewives of Atlanta star, 47, running errands in a black long-sleeve crop top with joggers and, yes, pink Balenciaga slides. Hair up, big sunglasses, a few phone calls, and a school pick-up run with her kids — very much the picture of trying to keep things moving while everything else is messy.
Where the custody fight stands right now
Earlier this month, a judge handed Kroy Biermann, 40, temporary primary physical custody of the four younger kids he and Zolciak share — Kroy Jr. (14), Kash (13), and twins Kaia and Kane (12). According to court documents reported by Us Weekly, Biermann also has final say, for now, on education, non-emergency medical, and religious decisions. The order came from a senior judge on April 29 and it is temporary; a full hearing is expected.
- Temporary order dated April 29 from a senior judge
- Biermann has temporary primary physical custody of Kroy Jr. (14), Kash (13), Kaia (12), and Kane (12)
- He has tie-breaking authority on education, non-emergency medical, and religious matters
- A full hearing is still to come; the current setup is not final
How we got here
This is the latest chapter in a very long, very public back-and-forth. Zolciak filed for divorce in May 2023, the two briefly reconciled, and by August 2023 the split was back on. In April of this year, Biermann filed an emergency motion accusing Zolciak of prioritizing her image and career over the kids and alleging neglect. He also claimed she was unstable, unfit to parent, and not following terms they had around therapy. Those are his assertions in court filings, not findings of fact.
Kim’s response (and the courtroom wrinkle)
Zolciak isn’t letting the April 29 order go unchallenged. She emphasized that the ruling is temporary and said the case landed in front of a senior judge because of Biermann’s emergency filing — a procedural move she argues got him a faster hearing than their originally assigned judge would have allowed. She also took aim at the guardian ad litem, calling the investigation flawed and saying the court-appointed figure barely engaged with her family over the last year.
"The senior judge's decision from April 29 is temporary until we return to court as soon as possible when we will have the opportunity for a full hearing."
To spell out her complaint: Zolciak says the guardian ad litem had not spoken to her in over a year until a brief call on April 28, and had not spoken to her boys since April 2025, aside from a quick 15-minute meeting in July 2025. Those are her dates, and yes, that timeline raises eyebrows — the gist is she believes there was minimal contact before the recommendation that influenced this temporary order. She says she’s looking forward to a full court date to lay everything out.
The family picture
Beyond the four minors at the center of the custody order, Zolciak is also mom to Brielle, 29, and Ariana, 24. Biermann legally adopted Brielle in 2013. Ariana is Zolciak’s daughter with her ex-husband Daniel Toce.
What to watch next
No firm date yet for the full hearing, but that’s the next major checkpoint. Until then, Biermann keeps temporary primary physical custody and decision-making authority on those key issues. Meanwhile, Zolciak has been out and about — and still doing school pick-ups — as the legal fight rolls on.
