Kroy Biermann Moves for Sole Custody as Kim Zolciak Divorce Battle Heats Up

Kroy Biermann moved Monday to end his and Kim Zolciak’s joint custody and take sole custody of their minor children, asking a Georgia judge for an immediate change, according to court documents obtained by Us Weekly.

Another turn in the Zolciak–Biermann divorce mess: Kroy wants sole custody of the kids, and he is asking a Georgia judge to move fast.

What Kroy is asking for

Per court papers Us Weekly says it obtained on Monday, March 30, Kroy Biermann, 40, is asking the court to ditch his and Kim Zolciak's current joint setup and give him primary custody of their four minor kids: KJ (14), Kash (13), and twins Kaia and Kane (11). He also wants the change made immediately.

In the filing, the former NFL player paints Kim, 47, as failing basic parenting duties — the language is pretty harsh — and says she has been out of the country and skipping her parenting time. He also claims that during one night the kids were with her, one of the minors was bitten by a dog. TMZ was first to report the new filing.

Kim fires back

Kim is not taking that quietly. In a statement to Us on Monday, she denied everything and said the work trip that took her away was exactly that — work.

"These accusations are completely false and nothing more than a deliberate attempt by Kroy to defame my character. I spent five weeks away working on two TV shows to support my family and make sure my children are cared for — something I will never apologize for. I refuse to be bullied or have lies twisted into a narrative about who I am. I will not stay silent, the truth is on my side, and it will come to light — no matter how hard anyone tries to bury it."

Us says they have reached out to Kroy's reps for comment.

Bottom line: the custody fight that started with their 2023 split keeps finding new gears. Kroy wants the judge to upend the current two-and-two arrangement now; Kim says the accusations are flat-out false and tied to her being gone five weeks to film two shows. Expect more filings — and more heat — before anything gets settled.
